Even so, in order to be entitled to equitable relief like an exparte TRO, Plaintiff must show (among other things) that there is ongoing or impending harm. Swanigan v. The evidence submitted in this case [14] supports allegations of infringement in July and August of 2024, which, in this Court's view, is too old to support a finding of ongoing harm at this time. And Plaintiff certainly has not demonstrated a basis for granting a temporary restraining order without notice to the named defendant under Fed. R. Civ. P. 65(b). Accordingly, upon review of Plaintiff's status report [15], the telephonic status hearing set for 4/30/25 [9] is stricken. By 5/8/25, Plaintiff is ordered to file a status report proposing next steps in this case, if other appropriate relief has not been sought by that date.
