Gottschall: By order 8 dated May 29, 2025, the court instructed plaintiff to show cause why joinder of the 32 defendants comports with Federal Rule of Civil Procedure 20(a)(2) and Bailie v. Schedule A Defendants, 734 F. Supp. 3d 798 (N.D. Ill. 2024). Plaintiff argues in her responsive memorandum of law 13 filed June 5, 2025, that joinder is proper under the "swarm" theory to Rule 20(a)(2) employed in Bose Corp. v. Defs. on Schedule A, 334 F.R.D. 511 (N.D. Ill. 2020). ECF No. 13 at 45. Plaintiff neither cites nor attempts to distinguish Bailie, in which this court declined to adopt Bose Corp.'s "swarm of infringers" theory. See id. Plaintiff also cites no case decided after Bailie. Having provided the court with no reason to revisit Bailie's holding, plaintiff has not demonstrated that defendants are properly joined under Rule 20(a).
