原告:Zheng v. The Corporations, Partnerships, and Unincorporated Associations Identified On Schedule A

# 日期 案件进程
15 2025-05-19 MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's renewed motion for leave to file under seal and for an extension of time 12 is denied as there is no motion for injunctive relief pending; the case will not proceed on an ex parte basis in the absence of such a motion. Further, the plaintiff seeks an extension of time to comply with the order issued on 4/23/2025 8 ; however, the plaintiff has already complied with that order. The Court denied the motion for TRO because the plaintiff failed to provide the materials specified by the Court on 4/28/2025 10. The plaintiff failed to move for an extension prior to that deadline, and cites no justification for the extension in its current motion. Mailed notice
14 2025-05-16 SEALED MOTION by Plaintiff Zhencai Zheng RENEWED MOTION TO SEAL (Attachments: # (1) MEMORANDUM IN SUPPORT OF PLAINTIFF'S RENEWED MOTION FOR LEAVE TO FILE UNDER SEAL AND/OR REDACTED DOCUMENTS, # (2) DECLARATION OF MARJORIE OUYANG IN SUPPORT OF PLAINTIFF'S RENEWED MOTION TO SEAL)
13 2025-05-15 MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff having failed to file the index and prior art analysis by 5/13/2025 as ordered by the Court on 4/28/2025 [10], the plaintiff's motion for a temporary restraining order [6] is denied. The plaintiff is ordered to unseal docket numbers 5, 6, and 7, and to take steps to serve the defendants named in this case. Mailed notice
12 2025-04-28 MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion for a temporary restraining order 6 is taken under advisement. By 5/13/2025, the plaintiff is required to supplement its motion with an index that matches each defendant to the screenshots supplied in support of the motion and lists the dates those screenshots were taken. The plaintiff is also required to provide evidence, via screenshots, that each individual defendant is capable of shipping its allegedly infringing products to Illinois. Finally, the plaintiff is also required to submit a supplemental document (1) analyzing which ornamental components are shared between each accused product and the asserted design patent, and (2) analyzing which of those shared features are not present in the prior art. This requires a product-by-product analysis. In other words, the plaintiff must provide, for each of the accused defendants' allegedly infringing products, an analysis of which components are shared or not shared with specified design patents as well as with the prior art. See ABC Corp. I v. Schedule A, 52 F.4th 934, 942-43 (district courts are "required to conduct the ordinary observer analysis" for design patents "through the lens of the prior art"). Mailed notice
11 2025-04-23 MINUTE entry before the Honorable John J. Tharp, Jr:By 4/30/2025, the plaintiff is required to file (1) a listing of all prior online trademark, copyright, or patent infringement cases (also known as "Schedule A" cases) filed in any court in the United States in which it was a plaintiff, and (2) a listing of any of the defendants included in the Schedule A in this case that the plaintiff has previously named as a defendant in any prior complaint or Schedule A case. The plaintiff's motion for leave to file documents under seal [4] is granted. The plaintiff's motion for TRO [6] is held in abeyance until that information is filed. The unredacted complaint, Schedule A to the complaint, and the patent registration information filed provisionally under seal [5] are permitted to remain under seal. Mailed notice
